TERMS OF SERVICE

 

These Terms of Service (“Terms”) govern your access to and use of Tennis Slam! Corporation, including any related services, features, content, and applications (collectively, the “Service”) operated by Tennis Slam! Corporation (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms.

 

IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

 

1) ELIGIBILITY (21+ ONLY)

The Service and our tournaments are available only to females who are at least 21 years old. By using the Service, creating an account, or registering for a tournament, you represent and warrant that you are female and 21 years of age or older. We do not knowingly allow minors to use the Service.

 

2) ACCOUNTS

You will need an account to register for tournaments or use certain features. You agree to:

- Provide accurate, current, and complete information;

- Maintain the confidentiality of your login credentials; and

- Be responsible for all activity under your account.

You must notify us promptly of any unauthorized use of your account.

 

3) TOURNAMENT REGISTRATION & PARTICIPATION

  1. a) Tournament Details. Each tournament page will list relevant details, including format, rules, scoring, dates, times, location, and fees. Tournament details may change due to weather, court availability, staffing, safety, or other circumstances.

 

  1. b) Registration. Registration is not complete until you receive confirmation from the Service and your payment is successfully processed.

 

  1. c) Rules & Sportsmanship. You agree to comply with:

- The tournament rules posted for the event;

- On-site venue rules; and

- Any directions from tournament staff or officials.

We may refuse entry, remove, disqualify, or otherwise restrict participation for unsportsmanlike conduct, rule violations, safety concerns, or behavior that negatively affects others, at our sole discretion.

 

  1. d) Results & Scheduling. We may publish brackets, match schedules, match results and related information. Schedules may be adjusted and matches may be delayed, shortened, rescheduled, or canceled at times by necessity.

 

4) FEES, PAYMENTS (PAYPAL), & REFUNDS

  1. a) Fees. Tournament fees and what is included will be displayed before checkout. Prices are subject to change for future tournaments.

 

  1. b) Payment Processing. Online payments are processed through PayPal (or its affiliates). Your payments and use of PayPal are governed by PayPal’s terms and policies. We do not control PayPal and are not responsible for PayPal errors, outages, or processing delays.

 

  1. c) Refund Policy. Refunds (if any) are governed by the refund policy stated on the tournament page (FAQ) at the time of registration.

 

  1. d) Chargebacks. If you initiate a chargeback or payment dispute without first contacting us to resolve the issue, we may suspend or terminate your account and deny future registrations, to the extent permitted by law.

 

5) PHOTOS, VIDEOS, AND PUBLIC RESULTS (MEDIA RELEASE)

  1. a) Public Posting. By participating in any tournament or event we organize, you acknowledge and agree that:

- Match results (including your name/handle, scores, and bracket position) may be posted publicly; and

- Photos and video taken at tournaments may be posted publicly and used to promote the Service and future events.

 

  1. b) License/Release. You grant Tennis Slam! Corporation a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce, publish, display, distribute, and create derivative works from your name, likeness, voice, and any photos/videos in which you appear that are captured in connection with tournaments or the Service, for business and promotional purposes, in any media now known or later developed.

 

  1. c) Opt-Out (Optional). If you wish to request that a specific photo be removed from our website or social media, contact us at tennisslaminfo@gmail.com . We will consider reasonable requests, but we do not guarantee removal in all cases (for example, where reposted by third parties or needed for recordkeeping).

 

6) ASSUMPTION OF RISK; HEALTH & SAFETY

Tennis and related activities involve inherent risks, including serious injury, illness, heat-related conditions, dehydration, collisions, falls, and property damage. You voluntarily assume all risks associated with participation and agree that you are responsible for determining that you are physically able to participate.

 

You agree to follow all safety instructions and to cease participation if instructed by staff/officials or if you feel unwell.

 

7) DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

 

8) LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TENNIS SLAM! CORPORATION, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, VOLUNTEERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO:

- YOUR USE OF (OR INABILITY TO USE) THE SERVICE; OR

- YOUR PARTICIPATION IN ANY TOURNAMENT OR EVENT.

 

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

 

9) INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Tennis Slam! Corporation and its owners, employees, contractors, volunteers, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

- Your participation in tournaments;

- Your use of the Service;

- Your violation of these Terms; or

- Your violation of any law or third-party rights.

 

10) THIRD-PARTY SERVICES & VENUES

Tournaments may take place at third-party venues, and the Service may integrate third-party services (including PayPal). We are not responsible for third-party acts or omissions, venue conditions, or the availability/performance of third-party services.

 

11) ACCEPTABLE USE

You agree not to:

- Use the Service for unlawful purposes;

- Attempt to gain unauthorized access to accounts or systems;

- Interfere with or disrupt the Service (including by introducing malware);

- Scrape or copy the Service’s content at scale without permission;

- Impersonate any person or misrepresent your affiliation; or

- Use the Service to send spam or unsolicited communications.

 

12) INTELLECTUAL PROPERTY

The Service (including text, graphics, logos, designs, and software) is owned by or licensed to us and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, or create derivative works from the Service.

 

13) PRIVACY

Our collection and use of personal information is described in our Privacy Policy, which can be viewed here. By using the Service, you agree to our privacy practices.

 

14) TERMINATION

We may suspend or terminate your access to the Service at any time if we believe you violated these Terms, created risk or potential legal exposure, or to protect the Service or other participants. You may stop using the Service at any time.

 

15) CHANGES TO THESE TERMS

We may update these Terms from time to time. Updates will be posted with a revised “Last Updated” date. Your continued use of the Service after changes become effective means you accept the updated Terms.

 

16) GOVERNING LAW; VENUE

These Terms are governed by the laws of the State of Georgia, without regard to conflict of laws principles. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Fayette County, Georgia, and you consent to personal jurisdiction and venue there.
